2. Applicability and General Provisions
2.1. These general terms and conditions apply to all orders, offers, agreements and deliveries of products via La Vie d'Ellemie's webshop.
2.2. By placing an order, the customer confirms that he/she has read and agrees to these terms and conditions.
2.3. Deviations from these terms and conditions are only valid if agreed in writing.
2.4. If any provision in these terms and conditions is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.

3. Use of the Website and External Apps
3.1. Our webshop is hosted via Wix.com, an external hosting provider. Wix may collect and process data according to their own privacy policy.
3.2. La Vie d'Ellemie uses third-party apps and services within Wix, such as:
 Payment processors (e.g. Stripe, PayPal, Bancontact)
 
 Shipping apps for track & trace
 
 Marketing tools for newsletters and advertisements
 
3.3. Third-party apps and services may have their own terms and conditions and privacy policies. La Vie d'Ellemie is not responsible for any damage or loss caused by the use of these third-party services.
3.4. By using our webshop, the client agrees to the terms and conditions of these third parties.

4. Products and Availability
4.1. La Vie d'Ellemie offers handmade illustrations and ceramic products. As the products are handmade, there may be slight differences in colour, shape and finish.
4.2. The images and descriptions of the products are as accurate as possible, but colours and details may vary slightly depending on the customer's screen.
4.3. All products are available while stocks last. If an ordered product is not available, the customer will be informed as soon as possible and a refund or alternative will be offered.

5. Prices and Payments
5.1. All prices are stated in euros (€), including VAT but excluding shipping costs, unless otherwise indicated.
5.2. La Vie d'Ellemie reserves the right to change prices at any time. However, the price at the time of ordering will remain valid.
5.3. Shipping costs are stated separately when ordering and vary by region and shipping method.
5.4. Payments can be made via:
 Bancontact
 
 Credit card (Visa/Mastercard)
 
 PayPal
 
 Bank transfer
 
 Other payment methods offered in the webshop
 
5.5. Payments are processed via external payment services (such as Stripe and PayPal). La Vie d'Ellemie is not liable for errors or delays caused by these services.

6. Order and Agreement
6.1. An order is only final after payment has been received and the client has received a confirmation e-mail.
6.2. La Vie d'Ellemie reserves the right to refuse orders in case of suspected fraud, abuse or payment problems.
6.3. The customer is responsible for filling in his/her details correctly.
6.4. Orders cannot be changed or cancelled after they have been processed.

7. Delivery and shipment
7.1. Orders will be shipped via recognised postal and courier services.
7.2. Estimated delivery times:
 Belgium: 2-5 working days
 
 Netherlands & Luxembourg: 3-7 working days
 
 Other EU countries: 5-10 working days
 
7.3. Delays in delivery by the carrier are beyond the responsibility of La Vie d'Ellemie.
7.4. If an order does not arrive within the expected period, the customer should contact La Vie d'Ellemie within 7 days.

8. Right of withdrawal and Return policy
8.1. The customer has the right to return a product within 14 days of receipt without giving any reason (right of withdrawal).
8.2. Conditions for return:
 The product must be returned unused and in its original packaging.
 
 Personalised or customised products are not eligible for return.
 
 Return costs will be borne by the customer, unless it is a fault of La Vie d'Ellemie.
 

9. Warranty and liability
9.1. Our products have a legal guarantee of 2 years, as prescribed by Belgian law.
9.2. La Vie d'Ellemie is not liable for damages resulting from improper use of the products.
9.3. La Vie d'Ellemie is not responsible for failures or errors in external apps used through Wix

10. Privacy policy and data protection
10.1. La Vie d'Ellemie processes personal data in accordance with the General Data Protection Regulation (GDPR).
10.2. Data will not be sold to third parties and will only be used for order processing and marketing purposes.

11. Intellectual Property
11.1. All illustrations, ceramic designs and content of La Vie d'Ellemie are protected by copyright.
11.2. Copying, reproducing or commercially using our designs, illustrations or texts without permission is prohibited.

12. Disputes and applicable law
12.1. Disputes will be settled according to Belgian law in a Belgian court.
12.2. Customers may submit a complaint via the European Commission's ODR platform: https://ec.europa.eu/consumers/odr.
